The trade law gives a certain protection to the user of a trade name (the name that a company’s records). Action against others based on your name is sometimes possible.

Based on your business name can under certain circumstances act against the use of an identical or similar name for another (usually competitor). For example, consider the case where someone has a domain name registers and using that looks like your business name.When there is a (potential) confusion among the public is prohibited to enter a trade name already used by another.

The protection on the basis of a trade name only extends to the area where the name is knownis (is in use).

When you register your business name as a trademark, allow much stronger. A trademark registration  you will get a monopoly, such as the Benelux or the European Union.
